How Is Child Custody Determined In Louisiana?

In any custody case, the best interests of the child or children are the most important factor. In general, Louisiana courts presume that joint custody is a child’s best interest since that keeps both parents more or less equally involved in their lives.

A parent can, however, challenge this presumption. They may be able to convince the court that joint legal or physical custody will not best serve the child’s needs when there are issues involved, such as parental drug or alcohol addiction, a history of child neglect or abuse, or a high-conflict situation.

What Is The Difference Between Physical And Legal Custody?

Child custody is split into physical and legal custody. Physical custody is where a child lives. Parents could split physical custody by creating a custody schedule and having designated days when each parent is responsible for their child’s needs. Legal custody is a parent’s right to decide how their children should be raised, such as their education or medical needs.

What Types Of Visitation Arrangements Are Available?

If a parent does not have custody of their child, they may still be given visitation time. This parent can have a set day and time where they can spend time with their child. In some cases, a parent can visit their child without supervision, but many parents are required to have supervised visitation. Parents can also have virtual visitation if travel is difficult.
